Open Library is a project developed by the American organization Internet Archive. The website is freely accessible from Belgium after a simple registration and is presented as a digital library. It offers a catalog of more than 2 million books. The website operates on a donation basis and allows its members to consult or download books without the permission of the rights holders, which constitutes a clear violation of current intellectual property rules. This practice was also declared illegal by the American courts (Exhibit 24) which convicted Open Library of massive copyright infringement following a lawsuit brought by several major publishers. Furthermore, the administrators of this website are not identifiable and the website does not contain the legally required notices as prescribed by Article XII.6 of the CISG. These facts demonstrate the awareness of the manifestly unlawful nature of the links disseminated on the Target site by those involved in putting them online, as well as the concrete difficulties faced by the Applicants in prosecuting those responsible for the Target site.
